The terms for using Olively.

1. Acceptance of Terms

By downloading, installing, or using the Olively iOS application, Android application, or web application (collectively, the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Olively ("we," "us," or "our").

2. Description of Service

Olively is available as an iOS application, Android application, and web application, designed to help individuals in relationships communicate more effectively and deepen their understanding of attachment styles. The App includes:

• Translate: Converting your messages into language that resonates with your partner's attachment style while preserving your original intent
• Decode: Helping you understand the underlying meaning of messages you receive from your partner, accounting for attachment style differences
• Relationship Pulse: A regular check-in tool that lets you reflect on the state of your relationship and track how it changes over time
• 7-Day Programs: Guided, multi-day programs with daily exercises designed to help you understand attachment styles and build healthier communication habits
• Library: Educational content, articles, and exercises about the four attachment styles and relationship dynamics

Certain features (including Translate and Decode) use artificial intelligence to process and transform communications. Results are suggestions only and should be used at your discretion. Educational content provided in the Library and Programs is for informational purposes only.

3. Eligibility

You must be at least 18 years old to use Olively. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account Registration

To use certain features of the App, you may need to create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Promptly update any information to keep it accurate
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Subscription and Payments

Olively offers subscription options that may vary by platform, region, promotion, and billing provider. The available plans, trial availability, billing period, renewal terms, and applicable fees are shown at the time of purchase in the App Store, Google Play, or web checkout flow.

• Recurring billing: Subscriptions automatically renew at the billing period and price disclosed when you subscribe unless cancelled before the renewal date.
• Trials and promotions: Free trials or promotional offers, when available, are governed by the terms shown during purchase and may differ by platform or account eligibility.

By subscribing, you agree to:

• Pay all applicable fees shown to you before purchase and any taxes charged by the applicable platform or payment provider
• Automatic renewal of subscriptions unless cancelled before the renewal date, subject to the renewal terms disclosed at checkout
• Manage subscriptions through your Apple ID account settings (iOS), Google Play account (Android), or Stripe customer portal (web), depending on where the subscription was purchased

Refunds are handled in accordance with Apple's App Store policies (iOS), Google Play's refund policies (Android), or Stripe's policies (web). Contact support for refund requests.

6. User Conduct

You agree not to use the App to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm another person
• Submit false or misleading information
• Interfere with or disrupt the App or its servers
• Attempt to gain unauthorized access to any part of the App
• Use the App for any commercial purpose without our consent
• Reverse engineer, decompile, or disassemble the App
• Use automated systems or software to extract data from the App

7. User Content

You retain ownership of any content you submit to the App, including messages for translation or decoding, Relationship Pulse check-ins, and any reflections or responses submitted within a program. By submitting content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you. We may also use anonymized, aggregated data derived from Pulse check-ins to improve our models and understand relationship trends in general, without identifying you individually.

You are solely responsible for the content you submit and represent that you have the right to share such content.

8. Intellectual Property

The App, including its design, features, and content (excluding user-submitted content), is owned by Olively and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

10. Not Professional Advice

IMPORTANT: Olively is not a substitute for professional therapy, counseling, psychiatric treatment, or medical advice. The App is designed as a communication tool only and does not provide mental health diagnosis, treatment, or professional relationship counseling.

If you are experiencing a mental health crisis, relationship abuse, or any emergency, please contact appropriate emergency services or mental health professionals immediately.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLIVELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR USE OF THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Olively and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

You may terminate your account at any time by deleting the App and contacting us to request deletion of your data.

14. Changes to Terms

We may update these Terms from time to time. Any changes will be reflected on this page with a revised "Last updated" date. For material changes, we may provide additional notice. Your continued use of the App after an update constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions. You agree that any action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Utah.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Olively regarding your use of the App.
