1. Acceptance of Terms
By downloading, installing, or using the olively iOS application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and olively ("we," "us," or "our").
2. Description of Service
olively is a voice-first iOS application designed to help individuals in relationships communicate more effectively by:
- Translate: Converting your messages into language that resonates with your partner's attachment style while preserving your original intent
- Decode: Helping you understand the underlying meaning of messages you receive from your partner, accounting for attachment style differences
The App uses artificial intelligence to process and transform communications. Results are suggestions only and should be used at your discretion.
3. Eligibility
You must be at least 18 years old to use olively. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
4. Account Registration
To use certain features of the App, you may need to create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Promptly update any information to keep it accurate
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
5. Subscription and Payments
olively may offer subscription-based services. By subscribing, you agree to:
- Pay all applicable fees as described in the App
- Automatic renewal of subscriptions unless cancelled before the renewal date
- Manage subscriptions through your Apple ID account settings
Refunds are handled in accordance with Apple's App Store policies. We do not provide direct refunds for subscription purchases.
6. User Conduct
You agree not to use the App to:
- Violate any applicable laws or regulations
- Harass, abuse, or harm another person
- Submit false or misleading information
- Interfere with or disrupt the App or its servers
- Attempt to gain unauthorized access to any part of the App
- Use the App for any commercial purpose without our consent
- Reverse engineer, decompile, or disassemble the App
- Use automated systems or software to extract data from the App
7. User Content
You retain ownership of any content you submit to the App, including messages for translation or decoding. By submitting content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you.
You are solely responsible for the content you submit and represent that you have the right to share such content.
8. Intellectual Property
The App, including its design, features, and content (excluding user-submitted content), is owned by olively and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, secure, or error-free
- The results obtained from using the App will be accurate or reliable
- Any errors in the App will be corrected
10. Not Professional Advice
IMPORTANT: olively is not a substitute for professional therapy, counseling, psychiatric treatment, or medical advice. The App is designed as a communication tool only and does not provide mental health diagnosis, treatment, or professional relationship counseling.
If you are experiencing a mental health crisis, relationship abuse, or any emergency, please contact appropriate emergency services or mental health professionals immediately.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLIVELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR USE OF THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless olively and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or violation of these Terms.
13. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.
You may terminate your account at any time by deleting the App and contacting us to request deletion of your data.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or by other means. Your continued use of the App after such changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
16. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and olively regarding your use of the App.
